    On December 20, 2016, Ropers Majeski partner, Robert M. Forni, Jr., obtained a judgment in favor of the defendant-insurer, Liberty Life Assurance Company of Boston, in a federal lawsuit arising from the termination of the plaintiff’s long-term disability (LTD) benefits under an employee welfare benefit plan governed by the Employee Retirement Income Security Act of 1974, 29 U.S.C. § 1001 et seq. (ERISA).

    When she was 41, the plaintiff ceased working as a producer/editor for NBC TV in May 2012 due to complaints of muscle pain, cervical spasm, sleep disturbance, digestive problems and work-related stress after she was removed from an assignment.

    On January 13, Ropers Majeski Partner, Robert M. Forni, Jr., obtained a verdict in favor of the defendant-insurer, Liberty Life Assurance Company of Boston, following a bench trial in a federal lawsuit arising from the termination of the plaintiff’s long-term disability (LTD) benefits under an employee welfare benefit plan governed by the Employee Retirement Income Security Act of 1974 (ERISA).

    When he was 60, the plaintiff, Donald DeLancey, stopped working in September 2014 as an “Admins IS Security Analyst” for the Automobile Club of Southern California due to a suspected stroke or transient ischemia attack (TIA) that he suffered on the day of a performance review, which he claimed resulted in cognitive impairments.
