Todd A. Roberts

Todd Roberts is the Resident Director of the Redwood City Office and heads the Commercial Litigation Practice group. He is a “home-grown” RMKB attorney, having been with the firm since graduating from law school in 1987. He was elected partner in 1993 and holds the highest professional and ethical rating from Martindale-Hubbell.  Mr. Roberts has also been repeatedly selected for inclusion in the Northern California Super Lawyers® list in the areas of Employment & Labor, Intellectual Property Litigation and Insurance Coverage.

Mr. Roberts' practice focuses on the defense of institutional clients, directors, officers, employers, real estate developers and brokers, and other professionals in highs stakes litigation throughout the U.S.

Directors and Officers Liability, and Commercial Litigation

Mr. Roberts' experience includes the defense of corporate officers and directors of private and publically traded companies for breach of fiduciary duty and related theories; specific performance and breach of real estate purchase contracts; for injunctive relief and damages in connection with the misappropriation of trade secrets; and a broad variety of other business disputes involving trademarks, trade dress and copyrights; the defense of claims alleging unlawful, unfair and fraudulent business practices under the California Unfair Business Practices Act.


Mr. Roberts’ employment practice focuses on the defense of employers and their officers and directors from claims of sexual harassment, discrimination, retaliation, misappropriation of trade secrets, wrongful termination, and wage and hour disputes. In addition to the state and federal courts, Mr. Roberts has represented clients in the State and Federal Courts, and before the Equal Employment Opportunity Commission, the California Department of Fair Employment and Housing, the Unemployment Insurance Appeals Board, the California Labor Commissioner and the National Labor Relations Board. Mr. Roberts also counsels employers on a variety of issues involving reductions in force, risk avoidance, ADA and best practices.

Real Estate

Mr. Roberts also represents commercial and residential real estate professionals, developers, owners and homeowners associations in connection with a wide variety of disputes, including purchase options, claims of misrepresentation, professional negligence, breach of fiduciary duty, easements, property lines, leases, and purchase contracts. Among his clients are national commercial and residential real estate companies.


Mr. Roberts has defended insurance carriers in over one hundred bad faith cases and has frequently represented insurers and their agents in coverage and other disputes with policyholders.  These disputes include claims for “advertising injury” liability, property insurance, employment practices liability insurance (EPL), real estate errors and omissions and a broad variety of specialty lines policies.  He was lead counsel and argued the case of Julian v. Hartford Underwriters before the California Supreme Court, prevailing in a 7-0 decision.  Mr. Roberts has served as counsel in numerous cases resulting in published decisions.  Mr. Roberts has also argued over 25 cases in the California Courts of Appeal and the U.S. Court of Appeals for the Ninth Circuit.

Volunteer and Board Memberships

  • Provided pro bono representation in a number of instances to aggrieved and underprivileged persons in the pursuit of civil justice. This is consistent with his instinct and passion for helping protect others.
  • Dean of the Litigation Management College sponsored by the Federation of Defense and Corporate Counsel, which he organizes and at which he teaches annually at Emory University in Atlanta, Georgia.
  • Active member and now serves in the leadership of the Federation of Defense & Corporate Counsel (FDCC).  He currently serves on the FDCC Board of Directors and several key committees. He has the honor of being selected the program chair of the 2017 Annual Meeting in Montreux, Switzerland and convention chair for the 2018 Annual Meeting in Wailea, Hawaii. Mr. Roberts has received the prestigious John Appleman Award for best section chair.

  • Active in community affairs in Menlo Park, California, and in his spare time announces the Menlo-Atherton High School football and boys varsity basketball games.
